As you may be aware, Blizzard is the owner of the famous trademark WORLD OF WARCRAFT in the United States and around the world. The unauthorized use of the WORLD OF WARCRAFT trademark constitutes trademark infringement, unfair competition, and trademark dilution in violation of federal and state laws.

Blizzard Entertainment, Inc. is a Delaware corporation organized and existing under the laws of the State of California, with a principal place of business at P.O. Box 18979, Irvine, California 92623. Plaintiff Vivendi Games, Inc. is the parent corporation of Blizzard Entertainment, Inc. Vivendi Games, Inc. is a Delaware corporation having a principal place of business at 6060 Center Drive, Los Angeles, California 90045

1ST NOTICE

It has recently come to Blizzard Entertainment Inc.’s (“Blizzard’s”) attention that your company is utilizing the World of Warcraft-brand trademarks and copyrights in an unauthorized manner on your website http://wotlkwiki.info/.

As you may be aware, Blizzard is the owner of the famous trademark WORLD OF WARCRAFT in the United States and around the world. The unauthorized use of the WORLD OF WARCRAFT trademark constitutes trademark infringement, unfair competition, and trademark dilution in violation of federal and state laws.

Blizzard hereby requests that your company immediately cease and desist all current and future use of the WORLD OF WARCRAFT trademark and any copyrights owned by Blizzard in the above cited website and any future websites.

Nothing in this letter is intended or shall be construed to constitute an express or implied waiver of any rights or remedies which Blizzard may possess in connection with this matter, all of which are hereby expressly reserved. This letter is not intended to be a complete recitation of the facts upon which this matter is based.

We are sure that this matter will be easily and expeditiously resolved with your company’s cooperation. Please contact us within ten (10) business days of the date of this letter so that we may confirm your compliance with the terms outlined above.

FINAL NOTICE

Vivendi Games, and its affiliated companies (collectively, " Vivendi Games") are the exclusive owners of copyrights and other proprietary rights in numerous software properties, including but not limited to Vivendi Games.

It has come to our attention that XXXXXX Technologies is the service provider for the IP address listed below, from which unauthorized copying and distribution (downloading, uploading, file serving, file "swapping" or other similar activities) of Vivendi Games property(s) listed below is taking place. We believe that the Internet access of the user engaging in this infringement is provided by XXXXXX Technologies or a downstream service provider who purchases this connectivity from XXXXXX Technologies.

This unauthorized copying and distribution constitutes copyright infringement under Section 106 of the U.S. Copyright Act. Depending upon the type of service XXXXXX Technologies is providing to this IP address, it may have legal and/or equitable liability if it does not expeditiously remove or disable access to the property(s) listed below, or if it fails to implement a policy that provides for termination of subscribers who are repeat infringers (see, 17 U.S.C. 512).

Despite the above, Vivendi Games believes that the entire Internet community benefits when these matters are resolved cooperatively. We urge you to take immediate action to stop this infringing activity and immediately inform us of the results of your actions. We appreciate your efforts toward this common goal.

The information contained in this notification is accurate. Under penalty of perjury, the undersigned is authorized to act on behalf of Vivendi Games with respect to this matter.
